1. About these terms

These Terms of Service ("Terms") govern your access to and use of banowi.com and any orders you place with Banowi ("we", "us", "our"). By browsing this website, creating an account, or placing an order, you agree to these Terms. If you do not agree, please do not use the site or place an order.

These Terms should be read together with our Privacy Policy, Shipping Policy, and Refund Policy, all of which form part of your agreement with us.

2. Who may order

You must be at least 18 years old, or have the consent and supervision of a parent or legal guardian, to place an order. By ordering you confirm that the information you provide is accurate and that you are legally able to enter into this agreement.

We currently sell and deliver within Pakistan only.

3. Products, descriptions and images

We describe our products as accurately as we can. Product photographs are illustrative — colour, finish, and minor design details may vary slightly from the images shown, because of screen settings and manufacturer batch differences. Accessories shown in photos are not included unless explicitly listed in the product description.

Product availability is not guaranteed. We may add, change, or discontinue any product at any time without notice.

Unless a product page expressly states otherwise, products are not covered by a manufacturer warranty. Your protection is the replacement and return process set out in our Refund Policy.

4. Pricing and currency

All prices are listed in Pakistani Rupees (PKR) and are inclusive of applicable taxes unless stated otherwise. Shipping and handling charges are shown at checkout before you confirm your order.

We may change prices, discounts, and promotional offers at any time. The price that applies to your order is the price displayed at the time you place it.

Occasionally a product may be listed at an incorrect price due to a typographical, system, or supplier error. Where this happens, we are not obliged to fulfil the order at the incorrect price. We will contact you to confirm whether you wish to proceed at the correct price or cancel, and we will cancel and notify you if we cannot reach you.

5. Orders and acceptance

Your order is an offer to buy. A confirmation email or message acknowledges that we received your order — it does not mean we have accepted it. A contract is formed only when we dispatch the order.

We may contact you by phone or WhatsApp to confirm an order before dispatch. This protects both parties against mistaken and fraudulent orders. If we cannot reach you after reasonable attempts, we may cancel the order.

We reserve the right to refuse, limit, or cancel any order, including where we suspect fraud, resale, abuse of promotions, an inaccurate or unreachable address, or a history of refused deliveries.

6. Cash on Delivery (COD)

Cash on Delivery is offered as a convenience across Pakistan. When you choose COD:

• You commit to accepting and paying for the order when the courier arrives at the address you provided.
• Please keep the exact amount ready where possible, as couriers may not carry change.
• You or an authorised person at the delivery address must be available to receive the parcel.

Refusing delivery of a confirmed COD order, or repeatedly being unavailable, causes us to bear the full two-way courier cost. Where this happens repeatedly, we may disable Cash on Delivery for your phone number or address and require advance payment for future orders. We may also decline future orders from that account.

7. Payment

We accept Cash on Delivery and any other payment methods displayed at checkout. Online payments, where offered, are processed by third-party payment providers; we do not store your full card details. You are responsible for any fees your bank or wallet provider charges.

8. Shipping and delivery

Delivery timelines shown on the site and in our Shipping Policy are good-faith estimates, not guarantees. Delivery is carried out by third-party couriers and can be affected by weather, courier backlogs, public holidays, security conditions, and address accuracy.

You are responsible for providing a complete, correct address and a reachable phone number. We are not liable for delays or failed deliveries caused by incorrect or incomplete details, or by nobody being available to receive the parcel.

Risk in the goods passes to you on delivery. Please inspect your parcel on arrival and report any visible damage immediately, as set out in our Refund Policy.

9. Cancellations, returns and replacements

You may cancel an order at no cost any time before it is dispatched by contacting us with your order number. Once an order has been handed to the courier it cannot be cancelled, but it may be eligible for return under our Refund Policy.

Returns, replacements, and refunds are governed by our Refund Policy, which forms part of these Terms. In summary: report damaged, defective, or incorrect items within 3 days of delivery with photos or video, and we will arrange a replacement or refund once verified.

10. Your account

If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Tell us promptly if you believe your account has been accessed without your permission. We may suspend or close accounts that breach these Terms.

11. Acceptable use

You agree not to use this website to:

• place fraudulent, fake, or bad-faith orders, or use another person's details without permission;
• interfere with, damage, probe, or attempt to gain unauthorised access to the site or its systems;
• scrape, copy, or republish our content, product listings, or images for commercial use;
• upload anything unlawful, abusive, defamatory, obscene, or infringing;
• breach any applicable law of Pakistan, including the Prevention of Electronic Crimes Act, 2016.

We may suspend access and report unlawful activity to the relevant authorities.

12. Reviews and customer content

If you submit a review, photo, question, or other content, you confirm it is your own honest experience and does not infringe anyone's rights. You grant us a non-exclusive, royalty-free licence to display, reproduce, and use that content in connection with our store and its marketing. We may edit or remove content that is abusive, misleading, off-topic, or unlawful.

13. Communications

By placing an order you agree that we may contact you by phone, SMS, WhatsApp, or email about that order, including confirmation, dispatch, and delivery updates. These are service messages and are necessary to fulfil your order.

Marketing messages are sent only if you opt in, and you can unsubscribe at any time using the link in our emails or by replying STOP, or by writing to us.

14. Intellectual property

The Banowi name, logo, site design, text, and original graphics are our property or used under licence, and are protected by applicable intellectual property law. You may not use them without our written permission. Third-party brand names and product images remain the property of their respective owners and are used for identification purposes only.

15. Third-party links and services

Our site may link to or rely on third-party services, including couriers, payment providers, fulfilment partners, and social platforms. We do not control those services and are not responsible for their content, policies, or performance, though we will help resolve issues relating to your order wherever we reasonably can.

16. Disclaimer

The website and its content are provided on an "as is" and "as available" basis. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, or that product descriptions and other content are complete or current at all times.

Nothing in these Terms excludes or limits any right you have that cannot lawfully be excluded, including your rights under applicable consumer protection legislation in Pakistan.

17. Limitation of liability

To the maximum extent permitted by law, our total liability to you in connection with any order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, including loss of profit, loss of opportunity, or loss of data, arising from your use of the site or from delivery delays.

18. Indemnity

You agree to indemnify and hold Banowi harmless against claims, losses, and reasonable costs arising from your breach of these Terms or your misuse of the website.

19. Events beyond our control

We are not liable for failure or delay in performing our obligations where this is caused by events outside our reasonable control, including natural disasters, strikes, courier or supplier failure, internet or power outages, epidemics, civil unrest, or government action.

20. Governing law and jurisdiction

These Terms are governed by the laws of the Islamic Republic of Pakistan. Any dispute arising out of or relating to these Terms or your order shall be subject to the exclusive jurisdiction of the courts at Lahore, Punjab.

We would much rather resolve things directly — please contact us first and give us a fair opportunity to put the matter right.

21. Changes to these terms

We may update these Terms from time to time. The version published on this page at the time you place an order is the version that applies to that order. Please review this page periodically.

22. General

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force. Our failure to enforce any right is not a waiver of that right. These Terms, together with our Privacy, Shipping, and Refund Policies, form the entire agreement between you and Banowi in relation to your use of this website.
